These Terms of Service (“Terms”) govern your purchase and use of the Vistara — Luxury Real Estate HubSpot Theme, developed and distributed by Tech Striker. Please read them carefully before purchasing or using the theme.

1. Acceptance of Terms

By purchasing, downloading, installing, or using the Vistara theme, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not purchase or use the theme.

2. Use of the Theme

Vistara is a HubSpot CMS theme intended for building and customizing websites within the HubSpot platform. You may use the theme to create websites for yourself or for clients, subject to the license you have purchased and the terms set out below.

3. License

Upon valid purchase, Tech Striker grants you a non-exclusive, non-transferable license to install and use the Vistara theme in accordance with your purchased license tier. A single license entitles you to use the theme as permitted by the applicable HubSpot Marketplace or Tech Striker licensing terms. The license does not transfer ownership of the theme to you.

4. Intellectual Property

The Vistara theme, including its source code, templates, modules, design, graphics, and documentation, is the intellectual property of Tech Striker and is protected by applicable copyright and other laws. All rights not expressly granted to you under these Terms are reserved by Tech Striker.

5. Disclaimer of Warranties

The Vistara theme is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Tech Striker does not warrant that the theme will be error-free, uninterrupted, or compatible with every third-party module, integration, or configuration.

6. Limitation of Liability

To the maximum extent permitted by law, Tech Striker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising out of or related to your use of, or inability to use, the Vistara theme — even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the theme.

7. Permitted Use

You may:

• Install and use the theme on HubSpot portals in accordance with your license;
• Customize the templates, styles, and modules to suit your or your client’s website;
• Use the theme to deliver completed websites to your clients.

8. Prohibited Use

You may not:

• Resell, redistribute, sublicense, or share the theme files as a standalone product;
• Reproduce or repackage the theme to create a competing product for distribution or sale;
• Remove, obscure, or alter any copyright, license, or attribution notices;
• Use the theme for any unlawful, infringing, or harmful purpose.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tech Striker operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.
